Preserve review rights and submission proof
No personal deadline is calculated. Use the actual notice, service event and responsible court or agency; a receipt date does not replace a different legal trigger.
Ordinary class-based periods: 7 / 5 / 3 / 1 years; conditions and exclusions apply
- Trigger
- Conviction or release from imprisonment, whichever is later; revocation may add a separate condition
- How to check timing
- Use ORS 137.225 class and disposition rules; do not infer a personal eligibility date
- Action
- Review eligibility, complete sentence obligations, coordinate OSP, motion/declaration and prosecutor service
- Destination
- Circuit court for record; prosecutor; OSP separate fingerprint request
- Receipt or sending
- Retain court/prosecutor proof and OSP mailing/response records; filing does not clear record
- Proof to keep
- Disposition, conviction/release/revocation records, sentence completion and all submission receipts
- Conditions and exceptions
- Other convictions, pending cases, excluded offenses and revocation can alter or bar relief
- If time may have passed
- No missed general application deadline is inferred; seek record-specific advice

General sequence; stages and conditional steps can differ. Source 1 · Source 2 · Source 3 · Source 4
Eligibility
- Choose the record type first: adult conviction, arrest/citation without charges, dismissal or acquittal. Juvenile, federal, Tribal, out-of-state records, pardons and post-conviction challenges are separate routes.
- For convictions, review ORS 137.225 exclusions, offense classification, conviction/release dates, sentence completion including financial obligations, other convictions, pending criminal or qualifying contempt proceedings, and probation revocation. No eligibility finding is made.

These are matters to verify, not a finding that you qualify. Incomplete facts and unreviewed exceptions remain unresolved.

Filing
- Use the adult packet’s conviction option for a conviction; its other options address dismissal/acquittal and arrest without a court case. File the signed motion/declaration in the circuit court for the record, serve the prosecutor and complete the certificate as instructed. Retain filed and served copies and receipts.
- The statute and motion identify no court filing fee for this set-aside motion. The OSP conviction-check form lists a separate $33 fee (form effective January 1, 2022); reconfirm it and any fingerprint-provider charge. Do not describe these as a court filing fee or promise all costs are waived.

No court filing fee for the qualifying motion; the conviction OSP check and fingerprint-provider costs are separate. Confirm applicability and current amounts. Confirm with the responsible court.

Deadlines
- Ordinary conviction waiting periods depend on class: B felony 7 years; C felony and qualifying person/abuse contempt 5; A misdemeanor 3; B/C misdemeanor, violation and other qualifying contempt 1, generally from conviction or release from imprisonment, whichever is later. All applicable conditions and exclusions still need review.
- Probation revocation can require the longer of the ordinary period or 3 years after revocation. Other convictions, pending proceedings, sentence obligations and excluded offenses can prevent relief. Arrest without charges, dismissal and acquittal use separate conditions; do not apply conviction periods to every record.
