General Oregon procedural explanations, not an individual legal determination. Source responses were captured October 18, 2026. Statutory editions, later amendments, operative dates, court rules, controlling decisions, case facts and local orders require review. A possible remedy is not permission or a prediction; missing facts do not establish that a law does not apply. Deadlines are not calculated.

Oregon criminal suppression and related pretrial motions

A suppression motion asks the trial court to exclude identified evidence on a supported legal ground. It differs from a discovery request and from a later appeal. Source 1 · Source 2

How this process generally works

  1. Identify evidence and authority
  2. Prepare a supported motion
  3. Obtain and preserve the ruling

General sequence; stages and conditional steps can differ. Source 1 · Source 2

Eligibility
  • What evidence is challenged?
  • Was there a warrant?
  • What specific factual or legal defect is claimed?
  • Has the trial court already ruled?

Source-linked explanation; applicability remains conditional. Source 1 · Source 2

These are matters to verify, not a finding that you qualify. Incomplete facts and unreviewed exceptions remain unresolved.

Preparation
  • Give counsel the warrant, reports, recordings and precise disputed facts.
  • Check the trial date, motion order and applicable court rules before choosing a filing.

Source-linked explanation; applicability remains conditional. Source 1 · Source 2

Forms

Check companion documents, signatures, confidential information and the filing court. Completed fields do not establish legal sufficiency. Forms metadata: Explore existing Forms Intelligence and official form profiles.

Filing
  • A specific filing route is not established in this guide. Check the official instructions and responsible court or agency.

Source-linked explanation; applicability remains conditional. Source 1 · Source 2

Deadlines
  • No complete deadline inventory or personal date calculation is supplied. Read the actual notice, order and current official instructions. If a date may have passed, seek prompt legal help rather than assume that no options remain.

Source-linked explanation; applicability remains conditional. Source 1 · Source 2

After filing
  • The statute calls for determination before trial. A challenge to a search-warrant affiant has additional requirements under ORS 133.693; it is not established by a general disagreement with the report.
  • The court decides the motion on the issues and record presented. Pretrial/omnibus procedures and the actual scheduling order must also be reviewed.

How the procedure usually proceeds

  1. Identify evidence and authority. Review what was seized, the warrant or asserted warrant exception, and the legal ground for exclusion. Statutory search/seizure suppression is addressed in ORS 133.673. Source 1
  2. Prepare a supported motion. The statute calls for determination before trial. A challenge to a search-warrant affiant has additional requirements under ORS 133.693; it is not established by a general disagreement with the report. Source 1
  3. Obtain and preserve the ruling. The court decides the motion on the issues and record presented. Pretrial/omnibus procedures and the actual scheduling order must also be reviewed. Source 1 · Source 2

Next steps to consider

  • Give counsel the warrant, reports, recordings and precise disputed facts. Source 1
  • Check the trial date, motion order and applicable court rules before choosing a filing. Source 1 · Source 2

Possible remedies and their limits

Exclusion of specified evidence

When to consider: When an applicable suppression ground is established.

Limits: Suppression is not automatic dismissal or a finding that every item of evidence is unusable. Different constitutional/statutory grounds require separate review. Source 1

Which laws or rules may govern?

These are conditional scope explanations. Missing facts do not prove that a law is excluded. Confirm the current text, case type, forum, dates and any exceptions before applying a rule.

Search/seizure suppression · ORS 133.673; 133.693; 135.037

May apply when: The evidence and claim fall within the relevant provision and procedural stage.

Does not govern the described route when: Civil discovery, a missing police report, federal/tribal suppression practice and an automatic retrial are outside this route. Source 1 · Source 2

Case-specific applicability: conditional.

Starting or answering an Oregon civil lawsuit: filing and service

An ordinary civil case begins with a filed complaint. Service gives the other side formal notice; an answer or motion is a separate court filing. A demand letter, settlement conversation or online form draft does not by itself complete those steps.

Stages · Remedies and limits · Law scope · Sources

Civil discovery: obtaining records, admissions and testimony

Discovery lets parties request relevant, nonprivileged information before decision or trial. Different tools apply to parties, nonparties, documents and testimony; a request is not permission to collect private material outside lawful process.

Stages · Remedies and limits · Law scope · Sources

Civil default: unanswered claims, default orders and default judgments

Default is a procedure for seeking relief when the opposing party has not appeared or defended as required. An order of default and a judgment by default are related but distinct; silence does not establish every procedural requirement or the amount recoverable.

Stages · Remedies and limits · Law scope · Sources

Collecting a judgment and challenging garnishment or exemptions

A money judgment establishes an enforceable award but does not make the court collect it for the creditor. Garnishment, debtor examination and execution have separate procedures, and some property or income may be protected.

Stages · Remedies and limits · Law scope · Sources

Residential eviction: notice, first appearance, answer and possession

An Oregon residential eviction (FED) is a special court process about possession. A termination notice is not itself a court judgment; the summons sets an appearance requiring prompt attention. A separate money dispute may follow a different route.

Stages · Remedies and limits · Law scope · Sources

Divorce or dissolution: petition, response, temporary orders and judgment

A dissolution case ends a marriage or qualifying registered domestic partnership and can address property, debts, support and children. Temporary orders manage issues while the case is pending; the final judgment determines the final terms.

Stages · Remedies and limits · Law scope · Sources

Changing custody or parenting time after a judgment

Modification asks the court to change an existing judgment. Enforcement asks that an existing term be followed. The requested change, current order, children’s circumstances and court jurisdiction must be identified before choosing a packet.

Stages · Remedies and limits · Law scope · Sources

Child-support review and modification through Oregon DOJ

The Oregon Child Support Program can review child or medical support and propose a modified order through its administrative process. A proposed change, an objection/hearing and a final order are different stages; this route does not itself change custody.

Stages · Remedies and limits · Law scope · Sources

Family Abuse Prevention Act restraining orders (FAPA)

FAPA is a civil protection route for abuse within specified family or household relationships. An initial petition, temporary order, service, contested hearing and later modification/renewal are separate stages; a petition is not an eligibility finding.

Stages · Remedies and limits · Law scope · Sources

Consumer debt collection: validation, lawsuit response and complaints

A collector’s notice, a civil summons and a garnishment writ require different responses. Disputing a debt with a collector addresses verification; defending a lawsuit or challenging garnishment uses the court process. Neither an agency complaint nor a collector dispute is a court ruling.

Stages · Remedies and limits · Law scope · Sources

Rental repairs: notice, habitability and limited tenant remedies

Residential repair problems can involve habitability duties and several different statutory remedies. Written notice, access, the type of defect and responsibility for the problem matter. The law does not give a universal permission to stop paying rent or deduct any repair bill.

Stages · Remedies and limits · Law scope · Sources

Choosing a civil protection route: FAPA, stalking or SAPO

Oregon has several civil protection processes with different relationships, conduct and findings. FAPA, stalking and Sexual Abuse Protection Orders (SAPO) should not be treated as interchangeable forms. The legal route depends on facts and existing orders.

Stages · Remedies and limits · Law scope · Sources

Oregon criminal arraignment and counsel

Arraignment addresses the charge and plea. Counsel and release questions need attention at the beginning of the case.

Stages · Remedies and limits · Law scope · Sources

Oregon criminal trial, verdict and sentencing

A criminal trial decides the charge; sentencing follows a conviction. Different motions and review routes address different errors.

Stages · Remedies and limits · Law scope · Sources

Oregon adult criminal or arrest record set-aside

A set-aside asks the court to set aside and seal eligible adult records. It does not use the same grounds or process as an appeal or PCR challenge.

Stages · Remedies and limits · Law scope · Sources

Appeal from an Oregon circuit-court civil judgment

A civil appeal seeks appellate review of an appealable trial-court decision. Appealable decisions, initiation requirements and a stay are separate questions.

Stages · Remedies and limits · Law scope · Sources

Judicial review of an Oregon agency order

Court review of an agency order is a different stage from the agency hearing. The order type and agency-specific statute determine the route.

Stages · Remedies and limits · Law scope · Sources

ODHS I/DD service hearing and continuation request

ODHS describes a hearing route for specified Intellectual and Developmental Disability service disputes. A request to keep services the same should be identified separately.

Stages · Remedies and limits · Law scope · Sources

Oregon unemployment decision hearing and appeal

A claimant can dispute an Oregon unemployment decision by requesting a hearing. The Employment Department directs requests to its channels before the decision becomes final.

Stages · Remedies and limits · Law scope · Sources

Oregon guardianship, conservatorship and objections

A protective proceeding concerns a living person. Guardianship addresses care and supervision; conservatorship addresses property, subject to the court order and statutory safeguards.

Stages · Remedies and limits · Law scope · Sources

Unpaid Oregon wages: BOLI claim and court options

An unpaid-wage dispute can involve a BOLI wage claim or a court action. A discrimination or equal-pay complaint raises a different issue and should not be mislabeled as ordinary wage collection.

Stages · Remedies and limits · Law scope · Sources

Workers compensation claim denial, hearing and review

A denied Oregon workers compensation claim may be contested through a WCB hearing. An ALJ hearing, Board review and court review are separate stages with separate instructions.

Stages · Remedies and limits · Law scope · Sources

Oregon DMV implied-consent suspension hearing

An implied-consent hearing addresses the validity of a proposed driving-privilege suspension. DMV distinguishes it from other administrative hearings/reviews; the related criminal case is a separate process.

Stages · Remedies and limits · Law scope · Sources

Oregon Tax Court: Magistrate and Regular Division review

Most Oregon Tax Court appeals begin in the Magistrate Division. A Magistrate Division decision may be challenged in the Regular Division through a new trial, subject to the governing requirements.

Stages · Remedies and limits · Law scope · Sources

Establishing legal parentage before custody or support

Legal parentage identifies a child’s legal parents. Acknowledgment, presumptions, administrative adjudication and court proceedings are different routes; genetic testing is not the whole law of parentage. Custody and parenting time require separate decisions.

Stages · Remedies and limits · Law scope · Sources

Enforcing an existing parenting-time order

Parenting-time enforcement addresses violations of an existing order. The court needs the order, the alleged violations and the requested remedy. It differs from initially obtaining custody or simply requesting a new parenting schedule.

Temporary custody, immediate-danger and status-quo orders

Temporary family orders manage issues while a case or modification is pending. Immediate-danger orders address emergency child-safety circumstances; status-quo orders preserve routines. Neither label by itself decides final custody.

Private and non-departmental adoption: petition, reports and judgment

Adoption creates a legal parent-child relationship through a court judgment. Private, relative, stepparent and agency adoptions can require different consents, notices, reports and inquiries. An adoption-record request is not a petition to adopt.

Adult or minor name and legal-sex designation changes

Court identity-record changes use different adult and minor forms and can involve different venue and notice rules. A judgment changes the court-recognized record but does not automatically update every agency’s identification or vital records.

Civil stalking protective order: temporary order and final hearing

The civil stalking process addresses repeated unwanted contact meeting statutory culpability, alarm/coercion and safety requirements. Temporary protection and a final stalking judgment are different stages. It is not a general remedy for every unpleasant message.

Sexual Abuse Protection Order: petition, service and contest

A Sexual Abuse Protection Order (SAPO) is a specific civil route for sexual abuse and reasonable fear within the statute’s conditions. It differs from family-abuse protection and criminal prosecution, and includes restrictions concerning relationships, ages and existing orders.

EPPDAPA protection for an older person or person with a disability

The Elderly Persons and Persons with Disabilities Abuse Prevention Act (EPPDAPA) provides a civil protection route with its own abuse, protected-person and danger requirements. It is separate from an adult-abuse report, a guardianship or a general money-recovery action.

Extreme Risk Protection Order: weapons restriction and court review

An Extreme Risk Protection Order (ERPO) addresses a statutorily defined near-term risk involving deadly weapons. It uses its own authorized-petitioner, evidence, service, surrender and review process; it is not a general no-contact or custody order.

Civil motions, hearings and trial preparation

A motion asks the judge for a particular ruling. A hearing on that motion may concern legal argument, evidence or both; a trial resolves the claims through the applicable proof process. Preparation should follow the actual issue, notice and scheduling order.

Civil court fees: waiver, deferral and review of the decision

A waiver and a deferral are different: one excuses a specified fee under the order, while the other postpones payment. Applications are tied to the case and fees identified, and a later court review can change the financial result.

Civil mediation, written settlement and court closure

A mediator helps parties seek agreement without deciding the case. Reaching terms, documenting a settlement and obtaining any needed dismissal or judgment are separate steps. Confidentiality has exceptions and does not make every preexisting document secret.

Individual bankruptcy in Oregon: preparation, filing and case duties

Bankruptcy is a federal court process, not an Oregon circuit-court debt-defense form. Chapter choice, disclosures, counseling, fees and continuing duties matter. Filing, an automatic stay and discharge are different legal events with important exceptions.

Residential foreclosure: notices, resolution conference and loss mitigation

A mortgage default, trustee-sale notice and foreclosure lawsuit are different stages. Oregon’s residential trust-deed conference requirements have exemptions. Counseling, conference participation and loan-modification review do not themselves guarantee a changed loan or stopped sale.

Rental security-deposit accounting and recovery disputes

A deposit dispute concerns the landlord’s accounting, lawful deductions and return of money after the relevant tenancy/possession events. Ordinary wear, damage and unpaid obligations are not the same. A demand and a court money judgment are different steps.

Contesting an Oregon traffic violation: court, plea and trial

Traffic violations use the court identified on the citation. Oregon’s central online fine process is for specified circuit-court cases and is not the way to request a contested trial. Justice and municipal courts supply their own local instructions.

Oregon probation violation and revocation proceedings

A probation violation proceeding concerns alleged noncompliance with an existing sentence. The allegation, possible response and sentencing authority must be examined separately.

Oregon public records request and denial review

Request records from the public body holding them. Review of a denial depends on who withheld the record, with a special route for elected officials.

Paid Leave Oregon benefit decision appeal

Paid Leave Oregon directs appeals through the program before referral to OAH. Benefit decisions, equivalent-plan disputes and employer contribution issues must be distinguished.

OHP service denial: CCO appeal and OHA hearing

For a health-service denial, the issuer matters: OHA describes CCO appeal followed by OHA hearing, while an OHA-issued denial can lead directly to an OHA hearing request.

Older-adult abuse report and EPPDAPA court protection

An abuse report asks protective agencies to assess safety and possible investigation. An EPPDAPA petition asks a court for specified protective relief; one does not automatically start the other.

Court participant ADA / ASL accommodation

Use the participant accommodation request. Interpreter professional certification, remote appearance and rescheduling are separate purposes.

Choose the court and governing rules

Identify the court, case type and document you received. Read the applicable statewide rules, district local rules and case orders together. Circuit, appellate, Tax Court, justice and municipal courts have different procedures. Federal and Tribal matters require their own rules and court contacts.

Filing, responses and fees

Identify whether you are starting a case or responding in an existing case. Keep the summons, notice and receipt date; ask about the correct filing or response, service and required date. Check filing status and any acceptance or rejection notice. A fee application or technical-support request does not automatically preserve a deadline.

Service, discovery, subpoenas and evidence

Distinguish serving a summons from serving later documents. Check the applicable service method and keep proof of service. For discovery, witnesses and subpoenas, confirm the governing rules, confidentiality restrictions and case orders. Organize your proposed exhibits, identify how they can be authenticated and ask about delivery and exchange instructions; collecting a document does not establish that it is admissible.

Motions, hearings, trial and dispute resolution

Read the hearing notice and any scheduling or pretrial order. Confirm location or remote access, exhibit exchange, witnesses and the purpose of the hearing. Ask which motion and response procedures apply. Mediation, arbitration and trial have different rules; participation does not automatically change other obligations.

Judgments, payment and enforcement

Obtain the entered judgment or order and identify the relief it grants. Ask counsel about enforcement, exemptions, objections, satisfaction or available review. Payment, a satisfaction filing and challenging an award are different actions. The revenue-agency garnishment source below addresses that agency’s collection process; do not use it as a universal private-creditor packet.

Appeals, judicial review and appellate records

Identify the decision being reviewed and ask promptly whether it is appealable, who can seek review and which filing route applies. An appeal is not simply a new trial. Arrange the designated record and transcript, follow brief and motion rules and confirm service. Filing an appeal does not automatically stay enforcement; obtain advice about any separate stay request. Use official fee and access instructions.

Criminal proceedings and representation

Keep charging documents, release conditions, hearing notices and orders. Ask defense counsel about arraignment, release, discovery, motions, trial, sentencing and review. A plea petition is a legal decision to discuss with counsel. Criminal procedural sources below are separate from the substantive Penal Code collection. This site does not provide a complete defense workflow or decide eligibility for appointed counsel.

Family, housing and small claims

Use the packet for your case type and role. Family service and modification, dependency cases, eviction and small claims use different processes. A modification request does not itself change an existing order. Do not assume that ordinary civil appeal or evidence procedures apply to a small-claims hearing. Ask about current court instructions and available legal help.

Agency hearings and Tax Court routes

Start with the agency decision and its review instructions. An agency hearing request, internal appeal and judicial review are separate stages, and different agencies use different routes. Tax Court proceedings have their own divisions, rules and filing instructions. A complaint or records request does not replace the review filing specified in your notice.

Language, disability access and legal help

Contact the responsible court about language interpretation, disability accommodations and accessible participation. Confirm requests and arrangements before the hearing. Court interpretation, agency language assistance and access to legal representation use separate processes.
