Identify the correct victim-rights court claim and protect contact information
Oregon Department of Justice / Oregon Judicial Department · Shared Oregon or applicable federal route
Official DOJ instructions link separate adult/juvenile claim forms and direct attention to the statutory court-claim deadline.
Where and how to proceed: prepare, file and follow up
Start here: Contact victim-rights help promptly and identify the adult or juvenile case court.
1. Is this for me?
People considering the named Oregon court or agency route; the court/agency and current law determine individual applicability.
Service area: Oregon or applicable federal route; confirm venue and agency jurisdiction.
2. What should I prepare?
Some documents may be conditional. Ask about alternatives. Checkmarks are temporary and are not saved or sent.
3. Where and how do I submit?
UTCR 4.100 places the claim with the clerk in the court where the criminal case is pending. Review the current statutory notice/order-to-show-cause steps; follow sealed supplemental contact-page instructions.
- Contact victim-rights help promptly and identify the adult or juvenile case court.
- Review the applicable Form 4.100.2a or 4.100.2b, current court requirements and the notice-based statutory timing.
- Describe factual events and the requested remedy; follow the separate sealed contact-information instructions.
- File through the court clerk’s accepted route, comply with notice/service directions, and keep contact information and receipts current.
Timing: Retained ORS 147.515(1) states 30 days from when the victim knew or reasonably should have known the supporting facts; a deficient claim dismissal can have a separate 7-day correction period. Confirm current law, the actual order and service rules immediately; no date is calculated.
4. What will it cost?
Retained ORS 147.502(3) prohibits court filing, service, motion and hearing fees for the described statutory proceeding. Private attorney and other expenses are separate.
5. What happens after I submit?
Read court orders promptly, including any reasons for dismissal and correction instructions. Keep the court informed of contact changes.
6. What if something goes wrong?
Not every asserted concern is an eligible constitutional claim, and available remedies have limits. The forms are older linked editions; confirm current acceptance before filing.
Language, disability and offline help
Ask DOJ, local victim assistance or a victim-rights attorney for help. Ask the court about interpreter/ADA access and safe contact arrangements.

Work through the existing instructions for this route. Reviewing a step does not complete a legal requirement.
Official source navigation reviewed on 2026-10-18. Confirm the correct court or agency, case stage, current accepted form, service rules and actual notice/event dates. No personal deadline, eligibility, legal violation, remedy or filing-readiness determination is made. The DOJ-linked claim forms print 10-13-09. The current DOJ enforcement page still links them; confirm the court’s current accepted version and procedure. Retained ORS is the official published chapter, not an independent check of every later session-law change. Direct DOJ requests returned verification interstitials. Retained DOJ evidence is official-URL web-tool text; hashes cover the extracts, not original publisher PDF/HTML response bytes.
