Choose EOIR FOIA for the appropriate records and track its response
U.S. Department of Justice, Executive Office for Immigration Review · Shared Oregon or applicable federal route
Official EOIR FOIA guide explains agency scope, identity/consent, records fees, status and administrative appeal directions.
Where and how to proceed: prepare, file and follow up
Start here: Confirm EOIR holds the records and whether direct court/BIA ROP access is the appropriate alternative.
1. Is this for me?
People reviewing the named federal agency service; the agency determines case-specific access, authority and applicability.
Service area: Oregon or applicable federal route; confirm venue and agency jurisdiction.
2. What should I prepare?
Some documents may be conditional. Ask about alternatives. Checkmarks are temporary and are not saved or sent.
3. Where and how do I submit?
Submit to EOIR’s FOIA Service Center through its PAL/current alternative, not to USCIS with a DHS request form.
- Confirm EOIR holds the records and whether direct court/BIA ROP access is the appropriate alternative.
- Describe the records and supply the required identity verification and consent/authority.
- Use the PAL link or accepted alternative in the current EOIR instructions and retain its reference.
- Track the request and review the actual determination letter promptly for any appeal or mediation option.
Timing: The page gives a 90-day administrative-appeal period from the FOIA response date and describes determination periods that are not promised delivery dates. Follow the actual response and current rules; no personal date is calculated.
4. What will it cost?
EOIR describes possible search, duplication, retrieval and scanning charges, with limited no-charge allowances for some requesters and a $25 notice/consent threshold. Confirm the actual fee arrangement; no total is calculated.
5. What happens after I submit?
Track in PAL or through official response contacts. Ask about the response/appeal process rather than filing duplicate requests.
6. What if something goes wrong?
FOIA does not require the agency to create records, answer research questions or correct the official ROP. An appeal of records handling is different from an immigration-court appeal.

Official source navigation reviewed on 2026-10-18. Confirm current agency jurisdiction, program-specific restrictions, accepted edition, fees, secure submission route and actual notice dates. No personal filing route, deadline, eligibility, status, travel permission or filing-readiness determination is made. EOIR is part of DOJ, not DHS. Privacy Act correction is limited and is not a method to correct the official ROP. Some requester information/contact wording is dated or malformed; use the current PAL and official response contacts. EOIR direct requests returned 401. Retained EOIR evidence is official-URL web-tool text; its hashes cover the extracts, not original publisher PDF/HTML response bytes.
