ODE IDEA due process: hearing request, both-party delivery and help: practical steps
Oregon Department of Education · Shared Oregon or applicable federal route
ODE explains formal IDEA due-process hearings and links the model request, required information, delivery instructions, legal-services listings and hearing timelines.
Where and how to proceed: prepare, file and follow up
Start here: Read the hearing overview, model request/information sheet and linked legal-help resources. Confirm who may request for the child/adult student and seek individual advice on standard or expedited timelines.
1. Is this for me?
IDEA disputes about identification, evaluation, placement, FAPE or EI services as described in the model form. The form explains adult-student and surrogate/guardian roles; do not assume a parent can request for every student age 18 or older.
Service area: Oregon or applicable federal route; confirm venue and agency jurisdiction.
2. What should I prepare?
Some documents may be conditional. Ask about alternatives. Checkmarks are temporary and are not saved or sent.
3. Where and how do I submit?
Read the model form and information sheet. Prepare the child/program information, factual concerns and proposed resolution to the extent known. Sign/date and mail, fax or email the request to BOTH ODE and the local school district, ESD or EI/ECSE program, following current official instructions.
- Read the hearing overview, model request/information sheet and linked legal-help resources. Confirm who may request for the child/adult student and seek individual advice on standard or expedited timelines.
- Prepare the required request content. The ODE model form is optional, but using another format does not remove the required information or both-party delivery.
- Sign/date and mail, fax or email to BOTH ODE and the local district, ESD or EI/ECSE program under the official instructions. Keep delivery/receipt evidence and follow ODE/OAH notices about next steps.
Timing: Review ODE's current hearing information/timeline documents promptly and get individual deadline advice. The form treats ODE receipt as filing and has distinct standard/expedited rules and exceptions; this guide calculates no due date.
4. What will it cost?
The reviewed overview and model form do not establish a court filing fee or a universal cost schedule. Confirm any applicable process costs and private attorney/expert charges separately; the no-cost mediation statement does not make every hearing expense free.
5. What happens after I submit?
Confirm receipt by ODE and the other party, save acknowledgments and review all ODE/OAH notices. The form treats ODE receipt as filing; do not substitute a sent-email timestamp for verified receipt.
6. What if something goes wrong?
This is a formal legal proceeding with content, service and timing requirements, exceptions and potential expedited rules. Ask ODE or qualified legal help about sufficiency/receipt issues and adult-student authority. This checklist is not an individual deadline calculation.
Language, disability and offline help
The model form asks whether an agency-provided interpreter is required and for the language. Complete that item if needed and confirm disability/communication accommodations with ODE/OAH.
Choose your step and follow-up instructions
Work through the existing instructions for this route. Reviewing a step does not complete a legal requirement.
This is a formal legal proceeding. The model form is optional, but required request content and both-party delivery still apply. The linked sheet describes filing limits, exceptions and expedited proceedings; this guide does not calculate an individual deadline or establish entitlement to a remedy or lawyer.
